CONSUMER GUARANTEE
Our products come with the consumer guarantees found in the Australian Consumer Law which
cannot be excluded, including guarantees that the products will be of acceptable quality. The
consumer guarantees are not affected by our returns policy above.
In the unlikely event that you receive products from us that do not comply with the consumer
guarantees, we will provide you with a refund based on the below:

● If we consider that the product has a major failure under the Australian Consumer Law
(eg. the product is unsafe, does not fit the description or is not fit for purpose), you can
return it and receive a credit note to be used in KBeautySell online store.
● If we consider that the product has a minor failure under the Australian Consumer Law
(eg. the product's packaging is cracked but does not affect the safety or use of the
product), we will provide a credit note to be used in KBeautySell online store.

Where a product is damaged through misuse, accident or abnormal use, the Australian
Consumer Law or any manufacturer’s warranty may not apply, and KBeautySell may choose
not to provide a refund, exchange or repair (if applicable).
KBeautySell will require proof of purchase (e-receipt or KBeautySell Star account history) before
providing a remedy under the Australian Consumer Law.
Consumer guarantees cannot be excluded or limited and are in addition to any manufacturer’s
warranties or extended warranties purchased by, or given to, you.

APPLICABLE LAW
KBeautySell online store is created and controlled by us in the State of Victoria, Australia. As
such, the laws of the Commonwealth of Australia and the State of Victoria, will govern these
Terms and Conditions. By using KBeautySell online store, you submit to the jurisdiction of the
courts of Victoria and Australia and agree that any legal action will only be commenced in these
forums. KBeautySell online store is available only to people who can form legally binding
contracts under applicable law.

AGREEMENT / ELIGIBILITY
In order to make purchases through KBeautySell online store, you will be requested to provide
your personal details. In particular, Customers must provide their real name, phone number, e-
mail address and other requested information as indicated. Furthermore, when ordering items,
you will be required to provide payment details. By entering your payment details you represent

eligibility. Individuals must have been issued a valid credit card by a bank acceptable to
KBeautySell, applications must be acceptable to KBeautySell and have authorised KBeautySell
to process a charge or charges on their credit card in the amount of the total purchase price for
the goods.

If you register on the KBeautySell online store, you will have an email address/username and
password for your KBeautySell Star account. You are responsible for maintaining the
confidentiality of your account, username and password and for restricting access to your
computer and mobile devices. You are responsible for keeping such information current,
complete, accurate and truthful. You agree to accept responsibility for all activities that occur
under your account, username and / or password. You agree to provide only current, complete,
accurate and truthful information. If you are accessing and using the KBeautySell online store
on someone else’s behalf, you represent that you have the authority to bind that person as the
principal to all Terms and Conditions provided herein, and to the extent you do not have such
authority you agree to be bound to these Terms and Conditions and to accept liability for harm
caused by any wrongful use of the KBeautySell online store or Content resulting from such

We reserve the right to refuse service and/or terminate accounts without prior notice if these
Terms and Conditions are violated or if we decide, in our sole discretion, that it would be in our
best interests to do so.

perform credit checks and, where KBeautySell considers necessary, to transmit or to obtain
information (including any updated information) about you to or from third parties from time to
time, including but not limited to your credit-card number, to authenticate your identity, to
validate your credit card, to obtain an initial credit card authorisation and to authorise individual

We reserve the right to only accept orders from those at least the age of majority in your state or
province of residence, or that you are the age of majority in your state or province of residence
and you have given us your consent to allow any of your minor dependents to use this site.

ACCEPTANCE OF YOUR ORDER OR BOOKING
Items are not reserved in your cart until order is submitted and finalised.
Once you have made your choice and your order or booking has been placed, you will receive
an email acknowledging the details of your order or booking. This email is NOT an acceptance
of your order or booking, just a confirmation that we have received it.

INDEMNITY
You indemnify us against any action, liability, claim, loss, damage, proceeding, expense
(including legal costs) suffered or incurred by us, arising from, or which is directly or indirectly,
relate to:

● your breach or non-observance of any term of these Terms and Conditions;
● any breach or inaccuracy in any of your representations or warranties; or
● your use of the KBeautySell online store.

INTENDED USE
By placing an order or making a booking with KBeautySell online store, you agree to use the
products only for their intended purpose. If you use the products for any other purpose you will
assume full responsibility for any loss or damage arising out of this use.

BREACH AND TERMINATION
If, in our reasonable opinion, you breach any provision of these Terms and Conditions we may
immediately issue a warning, temporarily suspend or permanently prevent your access to all or

parts of the KBeautySell online store. In any event, we may terminate these Terms and
Conditions (and your right to use the KBeautySell online store) at any time and for any reason
without prior notice to you.
